§ 8-159. Violations; penalty.

  • (a)

    The board of health, through its authorized agents and employees, is hereby empowered to enforce the provisions of this section pursuant to M.G.L.A. c. 40, § 21D.

    (b)

    Whoever violates the provisions of section 8-158 shall be penalized by a non criminal penalty of $50.00 for the first offense, $100.00 for the second offense and $300.00 for the third and each subsequent offense.

    (c)

    Each and every day of the violation shall constitute a distinct and separate offense.

    (d)

    Upon failure to pay said penalty, such further enforcement action as permitted by law may be initiated. An unpaid penalty shall be considered an "overdue obligation" in accordance with the terms of Code of Ordinances, section 2-144 and is subject thereto. The board of health through the director of public health may take such other, further and different action to enforce the provisions hereof as the law permits, including initiating a civil action seeking injunctive or other relief.
