§ 16-7. Prohibition of placing snow, ice, stormwater and erosion, siltation, sedimentation within the public right-of-way.

  • (a)

    No person other than the one employed directly or indirectly by the city or by the commonwealth, and while in the performance of necessary public duties, shall at any time place or leave any snow, ice or any debris or other material within the public right-of-way.

    (b)

    No work or activity shall be conducted on any property in such a manner so as to:

    (1)

    Cause dirt or debris to enter a street, sidewalk or any common sewer, drain or other street drainage structure;

    (2)

    Alter or increase the amount of surface stormwater runoff entering a street, sidewalk or any common sewer, drain or other street drainage structure.

    (c)

    The board of public works may, upon application in such form as the board may require, grant a permit for such work or activities subject to conditions and limitations as the board may require.

    (d)

    The provisions of this section may be enforced through noncriminal disposition pursuant to M.G.L.A. c. 40, § 21D. Whoever violates the provisions of this section shall be penalized by a penalty of $25.00 for each offense. Each and every day of the violation shall constitute a separate offense.
