§ 15-4. Powers and duties of purchasing director/agent.

  • The purchasing director/agent shall:

    (1)

    Be responsible for the procurement and disposal of all supplies, materials, equipment and property for all departments and offices of the city, including contracts for the construction, reconstruction or alteration of city buildings and property, and any services or purchases incidental thereto, and all laws covered under the Uniform Procurement Act, M.G.L.A. c. 30, § 39M, M.G.L.A. c. 30B, and M.G.L.A. c. 149, §§ 44A—44J and M.G.L.A. c. 7, §§ 38A½ to 38O. All city departments, boards or commissions seeking to award contracts regulated by M.G.L.A. c. 30, § 39M; M.G.L.A. c. 149, §§44A—44J; and M.G.L.A. c. 7, §§ 38A-38O shall coordinate with the purchasing director/agent on all such contracts.

    (2)

    Have authority to order or make inventories of the supplies, materials equipment and furnishing of any and all departments. Any department possessing excess or surplus personal property of any kind or description shall not sell, exchange, transfer or dispose thereof without first certifying such personal property as surplus to the purchasing director/agent; and, thereupon, the purchasing director/agent shall circularize all department and agencies as to their need for such surplus personal property, and if such need is determined, the purchasing director/agent may order transfer of such property from one department or agency to another, and inventory adjustments between the departments shall be made accordingly. Surplus property shall be disposed of by the purchasing director/agent.

    a.

    If the value of the property being disposed of is estimated to be more than $500.00, the purchasing department shall advertise for bids in a daily paper having a general circulation in the city for at least two consecutive weeks and shall award the sale of such property to the highest responsible bidder. If it is in the best interest of the city, the director of purchasing may reject any and all bids. Whenever the estimated value of the property to be sold is less than $500.00, the purchasing director may, without advertising, dispose of such property in the best way for the city.

    b.

    In the instance of disposal of vehicles donated to the vocational high school for training the students, the vocational high school may sell all vehicles with a value less than $5,000.00 using sound business judgment.

    (3)

    Prior to filling a vacancy for purchasing director/agent the city council shall review the adequacy of the then-existing job description for the position with the city personnel director, shall make such changes as may be appropriate and shall establish such qualifications as it may require. The purchasing director/agent shall be appointed by the city council for a term of three years to serve until a successor be duly appointed and qualified.
