§ 13-179. Regulations.

  • The Westfield Conservation Commission incorporates the regulations of the Massachusetts Department of Environmental Protection as contained in 310 CMR 10.00, et seq. Wetlands Protection, as may be amended from time to time hereafter, unless otherwise specifically noted herein.

    The Westfield Conservation Commission may adopt local regulations provided same are not inconsistent or incompatible with the provisions of M.G.L.A. c. 131. § 40, 310 CMR 10.00. et seq., or of this article pursuant to the following procedure. The Westfield Conservation Commission shall provide to the city law department a copy of all proposed local regulations for its review and comment. Thereafter, the Westfield Conservation Commission shall hold a public hearing on the proposed local regulations, said public hearing to be held no sooner than 14 days after notice of the date, time, location and summary of the substance of the proposed regulations is posted on a public bulletin board at the city municipal building and is published in a newspaper of general city-wide circulation. At said public hearing or at an open meeting subsequent thereto, the Westfield Conservation Commission shall be empowered to vote to adopt the proposed local regulations, said vote to adopt to be a two-thirds vote of those commission members present. All local regulations heretofore adopted by the Westfield Conservation Commission are hereby rescinded but may be restored, subject to the limitations and through the process, as set forth herein.
