§ 13. Duties of clerk generally; absence.

  • (a)

    Subject to subsection (b), the clerk shall attend all regular meetings of the council, and all special meetings of the council, but shall not be required to attend committee meetings except when the council convenes as a committee of the whole. The clerk shall keep the records of all meetings the clerk is required to attend and the clerk shall record the names of the members present. The clerk shall have the care and custody of the city records and of all documents, maps, plans and papers, respecting the care and custody of which no other provisions are made. The clerk shall maintain and keep on file all approved minutes of committees and make the minutes available for review by the public once received from a committee. The clerk shall maintain an accurate written list of the matters referred to each committee which shall include dates of referral and disposition. A copy of the list shall be available to any member upon reasonable request and to the public as required by law.

    (b)

    The city clerk shall designate an employee within the office of the city clerk to serve as clerk of the council pro tempore to perform the functions of clerk of the council at any meeting of the council for which the attendance of the clerk is required but which, due to temporary disability or other reason, the clerk is unable to attend. In the absence of the city clerk or the city clerk's designee, the council shall elect, as its first order of business, after nominations from the floor, one of its members to serve as clerk pro tempore.

    The clerk shall prepare for each member at such meeting a statement of the business to be transacted, to which shall be added a list of matters laid on the table or postponed to a day certain.
